These terms cover Obravetta's two partner programs: Creator Sponsorships (paid video content) and Referral Partners (commission on customers you refer). By applying or taking part, you agree to them. For sponsored content, your signed sponsorship agreement also applies, and if the two ever differ, your signed agreement wins.
Partners are independent contractors. Taking part doesn't make you an employee, agent or legal partner of Obravetta, and you can't make promises or sign anything on Obravetta's behalf.
2. Eligibility and applying
You must be at least 18 and able to enter a contract.
Applying is free and doesn't guarantee acceptance, a campaign or any earnings. We review every application and may decline any of them.
We look at the quality and authenticity of your recent content and audience, not follower count alone. We may ask for a screen recording of your account analytics before approving you.
Information you give us must be accurate. Misrepresenting your audience, views or identity ends your participation.
3. Creator Sponsorships
Every sponsored campaign is set out in a written agreement, signed online before any work starts. It lists the deliverables, platforms, due dates, fee and any performance bonus.
Approval
You send the finished content to Obravetta before posting. We may approve it or ask for one round of reasonable changes. Content posted without approval isn't eligible for payment.
Base fee
The base fee is paid after the approved content is published on the agreed account, with the required disclosures, as set out in your agreement.
Performance bonuses
Bonuses apply only when your agreement includes them. They're cumulative up to the stated cap and measured over the stated period (usually 30 days from posting).
Views are verified from your platform's own analytics. You'll provide a screen recording showing the post's views and audience location, and on Instagram the paid partnership label lets us see the post's insights.
Your agreement may require a minimum share of viewers in the United States for a bonus to count.
No bonus is paid on self-reported numbers alone, on views from paid promotion you bought yourself unless agreed, or on views we reasonably believe are fake.
Keeping content live
Sponsored posts stay published for at least 90 days unless your agreement says otherwise.
4. Referral Partners
Approved referral partners get a unique tracking link. Customers are credited to you when they sign up through your link within the tracking window (currently 60 days) and no other partner's link was used later.
Commission: 30% of each subscription payment Obravetta receives from a referred customer, for that customer's first 12 monthly payments (or the equivalent share of an annual payment, as calculated by our referral system).
Commission is earned only on payments we actually receive and keep. Payments that are refunded, disputed or charged back earn no commission, and we may deduct any commission already credited on them.
Commissions are reviewed monthly and paid about 30 days after the customer's payment, once your balance and tax details are in order.
Not eligible: referring yourself, your own business or accounts you control; customers who were already Obravetta customers or in an active trial; fake or incentivized signups.
Not allowed: spam, unsolicited bulk texts or emails, misleading ads or coupons, and bidding on "Obravetta" or similar terms in paid search ads.
Calls and texts: no autodialed or prerecorded calls, no texts to anyone who hasn't agreed to receive texts from you, and stop contacting anyone who asks you to. Follow the Do Not Call rules that apply to you. You're responsible for your own outreach.
Don't present yourself as Obravetta staff, and don't use the Obravetta name or logo in ads, profiles or domains without written approval.
If there's a disagreement about who referred a customer, Obravetta decides in good faith based on its tracking records.
5. Disclosures
You must clearly disclose your relationship with Obravetta every time you promote it, following the FTC's Disclosures 101 for Social Media Influencers and each platform's rules.
In videos: say or show "ad" or "paid partnership with Obravetta" in the video itself, not only in the caption.
In captions and posts: include #ad or "Sponsored" where it's easy to see, not hidden among hashtags or behind "more".
Platform tools: turn on Instagram's paid partnership label, TikTok's commercial content disclosure (Branded content) or YouTube's paid promotion setting, as applicable, in addition to your own disclosure.
Referral links: say that you earn a commission when you share your link.
6. Content and conduct rules
Only say true things about Obravetta, and only describe features it actually has. Don't describe experiences you haven't had.
No fake customers, fake reviews or testimonials, made-up results, or income or earnings promises.
No fake or purchased followers, views, likes or comments, and no bots or engagement schemes. Buying or selling fake indicators of social media influence is prohibited by FTC rules, and we'll end participation and withhold or recover payment if we find it.
No content that is hateful, harassing, sexually explicit, dangerous or illegal, or that infringes anyone else's rights, including music and footage you don't have the right to use.
AI tools and heavy editing are fine, as long as the result is honest and doesn't mislead viewers about the product or results.
7. Content rights
You keep the copyright in content you create. Paying for content doesn't transfer ownership. Your sponsorship agreement grants Obravetta a license to repost and share the approved content on Obravetta's own social accounts, website and emails for the period stated (usually 12 months). Using your content in paid advertising, or editing it into new ads, requires a separate written approval and fee. You confirm you have the rights to everything in your content.
8. Payments and taxes
Payments are made by direct deposit (ACH) or another business payment method we choose. We never pay through gift cards, cryptocurrency or personal payment apps, and we never pay for follows, likes or "exposure".
US partners must provide a completed Form W-9 through a secure link before their first payment. Partners outside the US provide the appropriate form (such as a W-8BEN). We never collect tax or bank details on our public application.
You're responsible for your own taxes. Obravetta issues tax forms (such as Form 1099-NEC) when required by law.
We may withhold or recover payment for content that breaks these terms or your agreement, for fake engagement, or for referred payments that are refunded or charged back.
9. Brand use
You may use the Obravetta name and logo only as provided by us, only to promote Obravetta under these terms, and never in a way that suggests you are Obravetta or speak for it. Don't create accounts, websites or ads that use the Obravetta name as your own.
10. Ending participation
Either side can end participation at any time with 7 days' written notice (email is fine). We may end it immediately for a breach of these terms. Approved, published sponsored content and commissions earned under these terms before the end date are still paid, unless they're tied to a breach. After it ends, stop using your referral link and the Obravetta brand. Previously published content may stay up as your agreement allows.
11. Privacy
We use the information in your application to review it, contact you about the programs and run your partnership, as described in our Privacy Policy. We'll only send you Obravetta marketing emails if you opt in separately, and you can unsubscribe anytime.
12. Changes and contact
We may update these terms. We'll post the new version here with a new date and, for active partners, email you about material changes before they apply. Changes don't affect a signed sponsorship agreement unless you agree in writing.
